Beiträge zum Internationalen und Europäischen Strafrecht / Studies in International and European Criminal Law and Procedure (IES)

Herausgegeben von Kai Ambos

The increasing importance of international, european and foreign criminal law and procedure led the publisher to start a new series on this topic. The series produces outstanding monographs, collectives and conference volumes on International, European and Foreign Criminal Law in German and English. International Criminal Law (in the narrow sense) has become increasingly important through the creation of many international tribunals, especially the International Criminal Court. It now exists as a supranational Criminal Law for most serious crimes, such as genocide, crimes against humanity and war crimes. It has been deeply influenced by International Humanitarian Law, especially on the issue of the criminality of acts committed during armed conflict. European Criminal Law is not supranational criminal law per se, but rather refers to the many layered and complex influence of the European integration on domestic criminal law. This influence is evidenced on the one hand by criminal law conventions drafted within the framework of the Council of Europe, especially the European Convention on Human Rights, and on the other hand by substantive and procedural rules issued by the EU that affect domestic law. The »Europeanisation« of criminal law is also demonstrated by the increased institutionalization in European Law Enforcement (Olaf, Europol, Eurojust). The law of jurisdiction deals with the issue of the competent jurisdiction, especially in cases of acts committed on foreign territory. It has gained in importance within the framework of a coalescing Europe due to the fact that serious crimes usually have a transnational reference. International Criminal Law, so defined (in the broad sense), rests in many ways on Comparative Criminal Law and, in this way, also on Foreign Criminal Law.
