In order to achieve politically agreed aims, competitive markets often undergo a regulatory transformation. Thereby, a field of tension is created between the free market and the regulatory market intervention. The author analyses in this context rule-making competences, legal limits and legal protection with regard to the used regulatory governance instruments. As a reference case for a regulatory transformation the example of the balancing energy market is used.
