The validity control of arbitration agreements is in a field of tension between different areas of regulation. The author takes the Pechstein-case as an opportunity to fundamentally review the structure of the validity control of arbitration agreements, paying heed to the legal problems of the Pechstein-case. In taking a dogmatic approach, the author thus resolves the existing tension between the various areas of regulation, particularly with regard to Section 1034 (2) of the German Code of Civil Procedure (ZPO).
