The thesis analyses the special status of animals in German private law with a new, overarching approach - by evaluating the impact of two key issues: on the one hand the emotional bond between humans and their pets and on the other hand animal welfare. It contains a comprehensive examination of animal case law, supplemented by comparative remarks. It also criticizes the inconsistent dealing with the two factors and develops proposals for a more objective and transparent application.
